A federal appeals court has ruled that the Affordable Care Act does not violate the U.S. Constitution’s ban on private businesses suing the government for a public purpose.
The 3-2 decision by the 10th U.P.C. panel of the Supreme Court on Monday upheld a lower court ruling in a case brought by insurance companies against the Obama administration.
The panel found that insurance companies have the right to sue for any and all government actions that are inconsistent with the law’s provisions and the Supreme Judicial Court had already ruled in a similar case.
The Supreme Court is expected to take up the matter next week.
